Overview

This website is operated by OMA. Throughout the Site, the terms ā€œOMA,ā€ ā€œwe,ā€ ā€œus,ā€ and ā€œourā€ refer to OMA.

OMA provides this website, including the information, content, features, tools, products, and services available through it, conditioned upon your acceptance of these Terms of Service and all other policies referenced in them.

These Terms of Service apply to all visitors and users of the Site, including customers, browsers, vendors, merchants, and individuals who submit content.

By visiting the Site, creating an account, purchasing a product, subscribing to communications, or otherwise using our services, you agree to be bound by these Terms of Service and our Privacy Policy.

Please read these Terms carefully. If you do not agree to them, you may not access the Site or use our services.

Our online store is hosted by Shopify Inc., which provides the ecommerce platform through which we offer our products and services.

1. Eligibility and online-store use

By using the Site, you represent that you are at least the age of majority in your state, province, or country of residence, or that you are the age of majority and have authorized any minor dependents under your supervision to use the Site.

You may not use the Site, our products, or our services for an illegal, fraudulent, abusive, or unauthorized purpose. You may not violate applicable local, state, federal, provincial, national, or international laws while using the Site.

You may not transmit viruses, worms, malicious code, or other technology intended to disrupt, damage, interfere with, or gain unauthorized access to the Site, our systems, or another person’s information.

A breach of these Terms may result in the suspension or termination of your access to the Site or our services.

2. General conditions

We reserve the right to refuse service, suspend access, cancel an order, or limit quantities when reasonably necessary, including in cases involving:

  • Suspected fraud or unauthorized activity
  • Incorrect product or pricing information
  • Inventory limitations
  • Misuse of promotional offers
  • Suspected resale or unauthorized distribution
  • Violations of these Terms
  • Conduct that may harm OMA, our customers, or our service providers

You may not reproduce, duplicate, copy, sell, resell, exploit, scrape, or commercially use any portion of the Site or services without our prior written permission.

Your use of the Site does not grant you ownership of any Site content or intellectual property.

3. Information presented on the Site

We make reasonable efforts to ensure that information on the Site is accurate and current. However, product descriptions, educational information, photographs, pricing, availability, and other content may occasionally contain errors, omissions, or outdated information.

Information provided on the Site is for general informational purposes and should not be relied upon as professional medical, legal, financial, or other specialized advice.

We reserve the right to correct errors, update information, and modify Site content at any time, subject to applicable law.

4. Products and handcrafted variations

OMA offers botanical fragrance, body-care, home-fragrance, personal-care, and related products and experiences.

Some products are made, blended, poured, filled, finished, or packaged by hand. Natural ingredients and handcrafted processes may result in reasonable variations in:

  • Color
  • Aroma
  • Texture
  • Clarity
  • Appearance
  • Weight
  • Finish
  • Botanical character
  • Packaging placement

These reasonable variations are inherent to handmade and botanical products and are not necessarily defects.

Natural aromatic materials may also develop or change slightly over time. Product appearance may differ from photographs because of lighting, screen settings, ingredient variations, or packaging updates.

We reserve the right to change product ingredients, materials, packaging, sizes, descriptions, and availability when reasonably necessary, provided that we comply with applicable labeling and consumer-protection requirements.

5. Product use and safety

You are responsible for reviewing the product description, ingredient information, directions, warnings, and other information supplied with a product before use.

Unless specifically stated otherwise:

  • Products are intended for external use only.
  • Products should not be ingested.
  • Avoid direct contact with eyes and other sensitive areas.
  • Discontinue use if irritation or an adverse reaction occurs.
  • Keep products out of the reach of children and pets.
  • Use candles and other flame-based products only as directed and never leave a flame unattended.
  • Store products according to their accompanying instructions.

Botanical, natural, or naturally derived ingredients can still cause sensitivities or allergic reactions. Consider performing a patch test before using a new topical product.

If you are pregnant, nursing, taking medication, receiving medical treatment, have a diagnosed health condition, or have known allergies or sensitivities, consult an appropriate healthcare professional before using products when necessary.

Information provided by OMA is not intended to diagnose, treat, cure, mitigate, or prevent any disease or medical condition.

6. Fragrance sensitivities

Fragrance preferences and experiences are subjective. A fragrance may smell different depending on the wearer, environment, application, storage, and natural variation in botanical materials.

We do not guarantee that a customer will personally prefer a fragrance or experience it in the same way as described in our marketing materials.

Customers with fragrance sensitivities, allergies, asthma, or other relevant health concerns should review available ingredient information and consult a qualified healthcare professional when appropriate before use.

7. Product availability and purchase limits

Certain products may be available exclusively online, in limited quantities, by preorder, as part of a seasonal release, through an in-person event, or for a limited period.

We may limit sales by customer, household, order, geographic area, or jurisdiction when reasonably necessary. We may also limit purchase quantities to prevent suspected fraud, unauthorized resale, or misuse of promotional offers.

We reserve the right to discontinue a product or service at any time.

Any offer made through the Site is void where prohibited by law.

8. Mystery boxes, archive items, samples, and limited releases

Products identified as mystery boxes, archive boxes, discovery boxes, collector boxes, samples, limited editions, final-sale items, discontinued products, or archive products may be subject to special conditions disclosed on the relevant product page.

The exact contents of a mystery or archive box may not be disclosed before purchase. Product types, fragrances, packaging, sizes, and quantities may vary.

A stated box value refers to the total regular or comparable retail value assigned to the included products at the time the box is assembled. It does not represent a cash value, refund amount, or guaranteed resale value.

Unless required by law or stated otherwise in our Refund Policy, mystery boxes, samples, personalized products, opened fragrance products, opened personal-care products, final-sale items, and archive products may be ineligible for return or exchange.

9. Prices, taxes, and payment

Prices are displayed in U.S. dollars unless otherwise stated.

Prices, promotional offers, and product availability may change without notice. Applicable taxes and shipping charges will be calculated and presented during checkout when required.

You agree to provide current, complete, and accurate billing and purchase information.

By submitting payment information, you represent that:

  • You are authorized to use the selected payment method.
  • The information you provide is accurate.
  • You authorize us and our payment processors to charge the applicable amount.

Payments are processed by third-party payment providers. OMA does not directly store complete payment-card numbers.

10. Orders and order acceptance

Submitting an order does not guarantee acceptance. An order is accepted when we confirm or fulfill it, subject to applicable law.

We may refuse, limit, or cancel an order for reasons including:

  • Product unavailability
  • Pricing or listing errors
  • Payment authorization issues
  • Suspected fraudulent or unauthorized activity
  • Apparent resale or distribution activity
  • Shipping restrictions
  • Violations of these Terms

If we cancel an order after payment has been collected, we will issue a refund for the cancelled portion to the original payment method, subject to our payment provider’s processing times.

We may contact you using the email address or telephone number supplied with your order if additional information is needed.

11. Shipping and delivery

Shipping and delivery estimates are estimates rather than guaranteed delivery dates unless we expressly state otherwise.

Delays may occur because of carrier operations, weather, natural disasters, high order volume, address errors, customs procedures, public emergencies, or other events outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address. Additional shipping charges may apply when an order must be reshipped because the customer supplied an incorrect or incomplete address.

Risk of loss and title will transfer as provided by applicable law and the terms of the selected carrier and transaction.

Any claim involving a lost, damaged, missing, or incorrectly delivered shipment should be reported promptly in accordance with our Shipping Policy.

12. Returns, exchanges, and refunds

Returns, exchanges, replacements, cancellations, and refunds are governed by our Refund Policy, which is incorporated into these Terms by reference.

Because fragrance, cosmetic, bath, body, and personal-care products may present hygiene, safety, or contamination concerns after opening, some products may not be eligible for return unless they arrive damaged, defective, or incorrect.

Nothing in these Terms limits any non-waivable consumer rights provided by applicable law.

13. Promotions, discounts, and gift cards

Promotional codes and discounts:

  • Must be used according to the terms of the applicable offer
  • Cannot be combined unless expressly permitted
  • Have no cash value
  • May be limited to one use per customer or household
  • May exclude certain products, collections, taxes, or shipping costs
  • May be changed or withdrawn before use, subject to applicable law

We may cancel or decline promotional activity that appears fraudulent, unauthorized, duplicated, or inconsistent with the stated terms.

Gift cards are governed by the terms disclosed when they are purchased and by applicable law.

14. Accounts

You may be able to create an account through the Site.

You are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.

You agree to promptly notify us if you believe your account has been accessed without authorization.

We may suspend or terminate an account that contains inaccurate information, is used fraudulently, violates these Terms, or threatens the security or operation of the Site.

15. Email marketing

You may voluntarily opt in to receive marketing emails from OMA, including messages about:

  • Products and launches
  • Restocks
  • Promotions and special offers
  • Events
  • Brand news
  • Educational or editorial content

Your agreement to receive marketing emails is not a condition of purchase.

You may unsubscribe from marketing emails at any time by using the unsubscribe link included in the email.

Unsubscribing from marketing emails will not prevent us from sending transactional or service-related communications, such as order confirmations, shipping notices, account notices, customer-support responses, recall notices, or legally required communications.

Email information is handled as described in our Privacy Policy.

16. SMS and mobile-message terms

This section applies only if you separately opt in to receive text messages from OMA.

Program description

By providing your mobile number through an OMA SMS opt-in form and affirmatively consenting, you agree to receive recurring automated marketing and promotional text messages from OMA at the telephone number you provided.

Messages may include:

  • Product announcements
  • Launch and restock notifications
  • Promotional offers
  • Shopping-cart or checkout reminders, where separately authorized
  • Event announcements
  • Brand updates
  • Customer-service or transactional messages, where applicable

Messages may be sent using an automatic telephone dialing system or similar technology.

Consent

Your consent to receive marketing text messages:

  • Is voluntary
  • Is not a condition of purchasing any product or service
  • Applies only to the telephone number you provide
  • Must be provided separately from consent to receive email marketing

By opting in, you represent that you are the account holder or customary user of the mobile number provided and that you are authorized to consent to receive messages at that number.

Do not provide a telephone number belonging to another person without authorization.

Message frequency and charges

Message frequency varies.

Message and data rates may apply depending on your mobile plan and carrier. OMA does not charge a separate fee for subscribing to the program, but your wireless carrier may impose charges.

Not all mobile devices or carriers may be supported. Carriers are not liable for delayed or undelivered messages.

Opting out

You may revoke your SMS consent and unsubscribe at any time by replying STOP to an OMA marketing message.

You may also use another opt-out method we make available.

After opting out, you may receive a final confirmation message. Following processing of your request, you will no longer receive marketing text messages unless you opt in again.

Other recognized opt-out words may also be processed where supported.

Changed or reassigned numbers

You agree to notify us or unsubscribe before discontinuing, transferring, or changing the mobile telephone number used to enroll.

You are responsible for ensuring that OMA is not instructed to send messages to a number that no longer belongs to you.

Privacy and mobile information

We use mobile information as described in our Privacy Policy.

We may share mobile information with service providers that help us operate and deliver the messaging program, including Klaviyo, telecommunications providers, platform providers, and technical vendors.

Mobile opt-in information and consent will not be sold or shared with third parties for their own unrelated marketing purposes.

SMS consent is not transferred to third parties or affiliates for their independent marketing purposes.

Program changes or termination

We may modify, suspend, or discontinue the messaging program, change the sending number, or update these mobile terms, subject to applicable law.

If our sending number changes, messages sent to the former number may not be received.

17. Privacy

Our collection, use, retention, and disclosure of personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference.

Please review the Privacy Policy before using the Site or submitting personal information.

18. Third-party services and tools

The Site may provide access to third-party platforms, payment providers, applications, integrations, links, or tools.

We do not control third-party services and do not guarantee their availability, security, accuracy, or performance.

Your use of a third-party service may be governed by that third party’s separate policies and terms. You should review those policies before using the service or providing information.

To the fullest extent permitted by law, OMA is not responsible for losses caused solely by your use of an unaffiliated third-party website, product, service, or platform.

19. Reviews, feedback, and user content

You may be able to submit reviews, photographs, comments, testimonials, suggestions, or other content.

You retain ownership of content you create. However, by submitting content to OMA or making it available through the Site, you grant OMA a nonexclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, edit, adapt, publish, translate, display, distribute, and promote that content in connection with our business, products, marketing, and services, subject to applicable privacy and publicity laws.

You represent that:

  • You own or control the rights required to submit the content.
  • The content is truthful and not misleading.
  • The content does not infringe another person’s rights.
  • The content is not unlawful, threatening, defamatory, obscene, abusive, fraudulent, or malicious.
  • The content does not contain malware or harmful code.

We may monitor, decline, edit, or remove user content when permitted by law, but we are not obligated to do so.

We will not use a customer’s name, image, or private communication as a public endorsement in a manner prohibited by applicable law.

20. Intellectual property

The Site and its content—including OMA’s brand names, trademarks, logos, product names, fragrance names, written content, photographs, graphics, packaging, artwork, videos, formulas to the extent protectable, designs, and website layout—are owned by or licensed to OMA and are protected by applicable intellectual-property laws.

You may use the Site only for personal, noncommercial purposes.

You may not copy, reproduce, modify, publish, distribute, display, sell, license, reverse engineer, create derivative works from, or commercially exploit protected OMA content without prior written authorization.

No provision of these Terms transfers any OMA intellectual-property right to you.

21. Prohibited uses

You may not use the Site or services to:

  • Violate any law or regulation
  • Infringe intellectual-property, privacy, publicity, or other rights
  • Engage in fraud, deception, impersonation, or unauthorized activity
  • Harass, threaten, abuse, or harm another person
  • Upload malicious code
  • Interfere with Site security or operation
  • Attempt unauthorized access to systems or accounts
  • Collect another person’s information without authorization
  • Spam, phish, scrape, crawl, or use automated extraction methods without permission
  • Misuse promotional offers
  • Resell products in an unauthorized manner
  • Use OMA content to train or operate a commercial artificial-intelligence system without written permission
  • Engage in conduct that could damage OMA, the Site, our service providers, or other users

We may restrict or terminate access for prohibited conduct.

22. Errors, inaccuracies, and omissions

The Site may occasionally contain errors or omissions relating to product descriptions, photographs, ingredients, pricing, promotions, shipping charges, availability, or delivery estimates.

We reserve the right to correct such errors, change information, or cancel affected orders when permitted by law, including after an order is submitted.

If an order is cancelled after payment has been collected, we will refund the cancelled portion.

23. Disclaimer of warranties

To the fullest extent permitted by applicable law, the Site and services are provided on an ā€œas isā€ and ā€œas availableā€ basis.

We do not guarantee that:

  • The Site will always be uninterrupted, secure, or error-free.
  • Every defect will be corrected immediately.
  • The Site will be free from all viruses or harmful components.
  • Site content will always be complete or current.
  • Products will satisfy every customer’s subjective preferences.

Some jurisdictions do not allow the exclusion of certain warranties. In those jurisdictions, the exclusions in this section apply only to the extent legally permitted.

Nothing in these Terms excludes any warranty or right that cannot lawfully be excluded.

24. Limitation of liability

To the fullest extent permitted by applicable law, OMA and its owners, officers, employees, contractors, suppliers, agents, licensors, and service providers will not be liable for indirect, incidental, punitive, special, exemplary, or consequential damages arising from or related to the Site, services, or products.

This may include loss of profits, revenue, savings, business opportunity, goodwill, or data.

Where liability cannot be excluded, OMA’s liability will be limited to the maximum extent permitted by law.

Nothing in these Terms limits liability that cannot lawfully be limited, including liability for fraud, willful misconduct, or other liability that applicable law prohibits us from excluding.

25. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless OMA and its owners, officers, employees, contractors, agents, service providers, suppliers, and licensors from third-party claims, liabilities, damages, judgments, and reasonable expenses arising from:

  • Your material breach of these Terms
  • Your unlawful use of the Site
  • Your infringement of another person’s rights
  • Content you submit
  • Fraudulent or unauthorized conduct attributable to you

This provision does not require indemnification for conduct caused solely by OMA’s own unlawful acts.

26. Events beyond reasonable control

OMA will not be responsible for a delay or failure caused by circumstances beyond our reasonable control, including natural disasters, severe weather, fire, flood, epidemic, pandemic, war, terrorism, civil unrest, labor interruption, government action, carrier disruption, utility failure, internet outage, supply shortage, or transportation disruption.

This section does not affect rights that cannot be waived under applicable law.

27. Severability

If any provision of these Terms is held unlawful, invalid, or unenforceable, the provision will be enforced to the greatest extent legally permitted or severed as necessary.

The remaining provisions will continue in effect.

28. Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

A waiver is effective only when expressly made in writing by an authorized representative of OMA.

29. Termination

These Terms remain effective until terminated by you or OMA.

You may stop using the Site at any time.

We may suspend or terminate your access if you violate these Terms, engage in suspected fraud or unlawful activity, threaten the security of the Site, or misuse our services.

Provisions that by their nature should survive termination—including intellectual-property, payment, disclaimer, limitation-of-liability, indemnification, and dispute provisions—will survive.

30. Entire agreement

These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and any other policies or product-specific terms posted on the Site, constitute the entire agreement between you and OMA concerning your use of the Site and services.

They supersede prior communications concerning the same subject matter.

31. Governing law and jurisdiction

These Terms and any dispute arising from them will be governed by the laws of the State of Georgia and applicable federal laws of the United States, without regard to conflict-of-law principles.

Except where applicable law gives you the right to bring a claim elsewhere, legal proceedings relating to these Terms or the Site must be brought in a state or federal court with jurisdiction over Fulton County, Georgia.

You and OMA consent to the personal jurisdiction of those courts.

Nothing in this section prevents either party from bringing an eligible claim in small-claims court or seeking appropriate injunctive relief.

32. Changes to these Terms

We may update these Terms to reflect changes in our services, business practices, or legal obligations.

When we update them, we will post the revised Terms and change the ā€œLast updatedā€ date.

Changes will apply prospectively unless applicable law permits otherwise. Your continued use of the Site after revised Terms take effect constitutes acceptance of those revised Terms.
